1. Purpose of this Bidding Policy

This Bidding Policy explains how offers are submitted on the Darlink platform and outlines the rights and obligations of buyers and sellers.

Darlink is an online real estate platform that connects buyers and sellers. Darlink is not a real estate agent, broker, or party to any transaction.

 


 

2. Definitions

 

  • Platform: the Darlink website and all related services

  • User: any person using the platform

  • Seller: a user listing a property for sale or rent

  • Buyer: a user submitting an offer

  • Offer: a proposed price submitted by a buyer, including any conditions

 

 


 

3. Registration and Verification

 

3.1. To submit an offer, users may be required to create an account.

3.2. Darlink may implement verification measures to improve trust and reduce misuse, such as:

 

  • email or phone verification

  • identity verification (if required)

  • additional verification methods when necessary

 

3.3. Verification does not guarantee the financial capacity, reliability, or intentions of any user.

 


 

4. Placing an Offer

 

4.1. Offers are submitted through the platform.

4.2. Buyers may be required to provide:

 

  • offer amount

  • financing status (optional but recommended)

  • additional conditions (if applicable)

 

4.3. All offers must be made in good faith and reflect a genuine intention to proceed.

 


 

5. Nature of Offers

 

5.1. An offer submitted on Darlink is not a legally binding purchase agreement.

5.2. A transaction becomes legally binding only when:

 

  • the buyer and seller reach a mutual agreement

  • a formal contract is signed (typically with a notary)

 

5.3. The seller is free to:

 

  • accept an offer

  • reject an offer

  • make a counter-offer

 

5.4. Darlink is not involved in negotiations and is not a party to any agreement.

 


 

6. Transparency

 

Darlink may display certain offer-related information (such as activity or timing) to improve transparency. Personal data of users is never publicly disclosed.

 


 

7.Communication

 

After an offer is submitted:

 

  • the buyer may receive a confirmation

  • the seller receives the offer details

 

Further communication and negotiation take place directly between buyer and seller unless otherwise specified.

 


 

8. Withdrawal and Expiry of Offers

 

8.1. An offer may be withdrawn before acceptance, unless otherwise agreed.

8.2. Sellers may define a response timeframe. After this period, the offer may expire.

8.3. Darlink does not manage or enforce deadlines between users.

 


 

 

9. Responsibilities of Buyers

 

The buyer is responsible for:

 

  • providing accurate and complete information

  • ensuring financial capacity

  • arranging inspections, valuation, or legal advice if needed

  • verifying all relevant property information

 

Darlink does not provide legal, financial, or tax advice.

 


 

10. Responsibilities of Sellers

 

The seller is responsible for:

 

  • providing accurate and complete property information

  • disclosing known defects

  • respecting agreements with buyers

  • complying with applicable laws and regulations

 

Darlink does not verify property information and cannot guarantee its accuracy.

 


 

11. Role and Limitation of Darlink

 

11.1. Darlink provides a platform to connect buyers and sellers.

11.2. Darlink is not:

 

  • a real estate agent

  • a party to the transaction

  • responsible for negotiations, contracts, or legal processes

 

11.3. Darlink does not guarantee:

 

  • that a property will be sold or rented

  • that an offer will be accepted

  • that users will fulfill their obligations

 

11.4. Darlink reserves the right to:

 

  • remove abusive or unrealistic offers

  • suspend or block accounts in case of misuse

  • correct obvious technical errors

 

 


 

12. Logging, Evidence and Privacy

 

12.1. For security purposes, Darlink may collect:

 

  • IP address

  • date and time of actions

  • user and property data

  • technical session information

 

12.2. Personal data is handled according to the Darlink Privacy Policy.

12.3. In case of disputes, relevant data may be shared with competent authorities if required by law.

 


 

13. Abuse and Sanctions

 

It is strictly prohibited to:

 

  • submit fake or misleading offers

  • impersonate another person

  • manipulate the transaction process

  • use abusive or inappropriate language

 

Darlink may:

 

  • issue warnings

  • cancel offers

  • suspend or block accounts

  • report serious violations to authorities

 

 


 

14. Liability

 

14.1. Darlink is only liable for direct damages caused by a proven technical failure of the platform, where liability cannot be excluded by law.

14.2. Darlink is not liable for:

 

  • disputes between users

  • missed opportunities or transactions

  • incorrect information provided by users

  • indirect or financial losses

 

 


 

15. Applicable Law

 

All use of the platform and related transactions are subject to applicable laws and regulations in Morocco.

 


 

16. Changes to this Policy

 

Darlink may update this policy at any time. The latest version will always be available on the website. Continued use of the platform implies acceptance of the updated policy.
